Condition of machine to sell

Hi coffeekisser certainly worth gaining a consensus on the. In answer to your question, your machine could not be described as "as new" or even "near new" or even "excellent condition. To me, those terms would be reserved for a unit that was unboxed, used a few times but was highly polished with barely a smudge mark on it i.e. it looks like a demo unit. Clearly, given the photos above, that is not the case. With a good clean up, perhaps "very good condition" would pass muster.

Ouch that is rough, if the machine is only a year old it has been flogged.
If that is from a retailer I would be threatening asking for a part refund or placing a chargeback. If it was from eBay you could lodge a dispute and negotiate a refund or partial refund.
Facebook/Gumtree prob a lost cause, but you could ask the seller to come to the party or return for a refund.
