    as a trader (and a CS sponsor) I dont quite understand how another trader can say the hopper is not covered by warranty. The only way this could legitimately happen, is if the trader honestly believes or there is evidence to show, that the hopper has been damaged after purchase.

    Warranties generaly cover defective manufacture & assembly, EXCLUDING damage caused to the equipment through abuse, neglect, misuse, vermin, or if it is the subject of an accident (eg if dropped), fire or damage AND, if any alterations are effected except by authorised service agents.

    So assuming none of the above applies in your case, I will repeat what others have said that you should  stick to your guns (politely) with your vendor.

    This doesnt (shouldnt) need to be difficult, and I think you will find there will be no need to worry about Consumer Affairs Bureau etc.

    Further to what luca said...

    Your transaction (purchase) is with the vendor not the manufacturer.
    Warranties are honoured by manufacturers.
    Sometimes vendors try to pass everything off to the manufacturer and in this case (if the hopper was not known by you to be faulty when purchased) are trying it on.

    The Fair Trading Act says the vendor has to make good your loss.
    They can then take up the issue with the manufacturer, who in their case is their vendor.

    You as the consumer have the choice of Repair, Replacement or Refund.
    And I repeat, it is YOUR choice, not theirs.

    If you stick to your guns you should win.

    Consumer Affairs will even make a friendly telephone call on your behalf once you fill in the simple complaint form (if it gets that far).

    Just check your local Fair Trading and the Australian Competition and Consumer Commission
    websites for detailed help.

    If the hopper is "majorly defected," such that the grinder is not "of merchantable quality," which basically means that theyre not fit for use, they will be covered by a term implied into the contract of sale by s 32I of the Fair Trading Act and s 32L prevents that coverage from being excluded.  Of course, if you bought knowing that, youre boned.

    Whoda thought that a law degree could actually be useful ...

    Anyhoo, you should probably be able to get a replacement hopper from Mocopan.

    Might I say yet again, its worth dealing with sponsors....because we have integrity and were here because were passionate about what we do... $20 saved in an evilBay transaction may well come back to bite when the vendor suddenly develops chronic amnesia....
